Terms of Use

These Terms of Use govern access to SwimQuest and the use of its features. By creating an account or using the service, you confirm that you have read and accepted these terms.

1. About SwimQuest

SwimQuest is a digital service dedicated to preparing, organizing, and tracking swimming activities. The service may allow you to view or create workouts, plan sessions, keep a journal, record progress, share certain content, and receive account-related communications.

SwimQuest is operated by Kiwad inc. in Quebec, Canada. In these terms, “SwimQuest”, “we”, and “our” refer to the service and its operator.

2. Eligibility and accounts for minors

A person aged 14 or older may create their own account. For a person under 14, the account must be created and supervised by a parent or legal guardian who accepts these terms on the child’s behalf.

The parent or guardian remains responsible for the child’s use of the account and must ensure that the information provided is accurate and appropriate.

3. Account creation and security

You must provide accurate, current, and complete information. You are responsible for keeping your credentials confidential, for activity carried out through your account, and for promptly notifying us of any unauthorized use.

An account is personal. It must not be sold, transferred, improperly shared, or used to bypass an access restriction. We may require email confirmation or other reasonable verification measures to protect the service.

4. Beta phase and invitation codes

During a beta phase, access may be limited to people who hold a valid invitation code. A code may be personal, time-limited, or limited to a maximum number of uses. We may withdraw, suspend, or replace a code in the event of an error, abuse, security risk, or the end of a campaign.

A beta version may contain defects, interruptions, and incomplete features. Data and features may change before the public launch.

5. Permitted use

You may use SwimQuest for personal and lawful purposes, in accordance with applicable laws and these terms. In particular, you agree not to:

  • access an account, data, infrastructure, or feature without authorization;
  • disrupt the service, bypass its security measures, or automate abusive requests;
  • publish content that is unlawful, misleading, hateful, harassing, discriminatory, or infringes the rights of others;
  • upload malicious software or attempt to extract service data in bulk;
  • use SwimQuest to provide an unauthorized commercial service or impersonate another person.

6. User-created content

You retain the rights you hold in the content you create. You nevertheless grant us a limited, non-exclusive, worldwide licence to host, reproduce, technically adapt, and display that content only to the extent necessary to operate, secure, and improve SwimQuest according to the visibility settings you choose.

You must hold the necessary rights to any content you submit. We may remove or restrict content that violates these terms, the law, or another person’s rights.

7. Public content and sharing

Certain content may be made public or shared by link. Before publishing, make sure it does not contain personal information you do not wish to disclose. Public content may be viewed, copied, or reshared by other people outside our control.

8. Health, training, and safety

SwimQuest provides organizational tools and informational content. The service is not a substitute for advice from a physician, qualified coach, lifeguard, or other professional. Workouts must be adapted to the person’s age, experience, physical condition, and circumstances.

Swimming involves risks. Never swim alone in an unsupervised environment, follow the rules of the swimming location, and stop the activity if you experience discomfort, unusual pain, or a dangerous situation.

9. SwimQuest intellectual property

The service, its visual identity, code, interfaces, editorial texts, databases, and original content are protected by intellectual property laws. Nothing in these terms transfers those rights to users.

You may not reproduce, modify, distribute, or exploit a substantial part of the service without authorization, except where expressly permitted by law.

10. Third-party services

SwimQuest may use or offer third-party services, for example for authentication, email delivery, hosting, performance analysis, or sharing. These services may be governed by their own terms and policies. We do not control their platforms or service interruptions.

11. Service availability and changes

We aim to provide a reliable service, but we do not guarantee continuous access, error-free operation, or the absence of data loss. We may perform maintenance, modify a feature, impose reasonable limits, or discontinue part of the service.

When reasonably possible, we will try to notify users of an important change that has a significant effect on their use of the service.

12. Account suspension and closure

You may stop using the service and request that your account be closed. We may suspend or close an account in the event of a violation of these terms, fraud, a security risk, a legal obligation, or use that compromises the service or other people.

Closure may lead to the deletion or anonymization of certain data, subject to backup retention periods and the legal obligations described in the Privacy Policy.

13. Disclaimer and limitation of liability

To the extent permitted by law, SwimQuest is provided “as is” and as available. We do not guarantee that a program or workout will produce a particular athletic result.

We are not responsible for damages arising from misuse of the service, a training decision made without appropriate supervision, content provided by a user, a third-party service, or an event outside our reasonable control. Mandatory protections under applicable law remain unaffected.

14. Indemnification

To the extent permitted by law, you agree to indemnify us against claims resulting from your content, your unlawful use of the service, or your intentional violation of these terms.

15. Changes to the terms

We may update these terms to reflect changes to the service, the law, or our practices. The effective date is shown on this page. For an important change, we may request renewed acceptance or provide reasonable notice.

16. Governing law

These terms are governed by the laws applicable in Quebec and Canada. Any dispute will be submitted to the courts of competent jurisdiction in Quebec, subject to mandatory consumer rights.
