Effective date : 2026-08-04
\n\nThis policy explains what personal information SwimQuest collects, why it is used, with whom it may be shared, and what choices are available to you.
1. Person responsible for personal information
SwimQuest is operated by Kiwad inc. in Quebec, Canada. The person responsible for the protection of personal information can be reached at [email protected].
2. Information we may collect
Depending on the features you use, we may collect:
- account information such as your email address, technical identifier, language, and preferences;
- the context in which the account was created, including whether the account belongs to a person aged 14 or older or to a child accompanied by a parent or guardian;
- records of consent, including the version of the terms accepted, the acceptance date, and the newsletter choice;
- content and usage data such as workouts, favorites, journals, goals, sessions, comments, and settings;
- technical data needed for security and operation, such as IP address, browser, device, error logs, session cookies, and login events;
- information you provide when you contact us or request support.
We ask that you not enter detailed medical information or other sensitive information that is not necessary for the operation of the service.
3. Information about children
For a person under 14, the account must be created with the consent of a parent or legal guardian. We aim to limit collection to information reasonably necessary for the service.
The parent or guardian may contact us to access, correct, or request deletion of information associated with the child’s account, subject to applicable legal obligations.
4. Purposes of collection and use
We use personal information to:
- create, authenticate, and administer accounts;
- validate beta invitations and prevent abuse;
- provide, personalize, and synchronize requested features;
- send necessary transactional messages, such as email confirmation or security notices;
- send the newsletter only when separate consent has been given;
- respond to support requests;
- maintain security, diagnose errors, and improve performance and accessibility;
- comply with legal obligations and enforce our rights.
5. Basis for processing and consent
We collect and use information with your consent, to provide the requested service, to comply with a legal obligation, or when the law permits another basis. You may withdraw optional consent, including newsletter consent, without losing access to essential account features.
Certain information is nevertheless required to create and secure an account. Refusing to provide it may prevent use of the relevant feature.
6. Communications and newsletter
Communications related to the operation, security, or administration of the account are not promotional messages and may be necessary for the service. News, tips, and updates are sent only after separate consent.
A marketing subscription may be withdrawn using the unsubscribe link in the message or by writing to us.
7. Cookies and similar technologies
We use strictly necessary cookies to maintain the session, remember certain settings, protect forms, and secure authentication. Limited measurement tools may also be used to understand the performance and general use of the service.
Where required by law, non-essential technologies are enabled only after an appropriate choice. Your browser can also block certain cookies, but doing so may prevent some features from working properly.
8. Service providers and disclosure of information
We may share information with providers that help us operate SwimQuest, including for hosting, security, email delivery, authentication, technical monitoring, and support. These providers must process information only for the agreed services and under appropriate safeguards.
We may also disclose information when required by law, to prevent fraud or a security incident, to protect a person’s rights and safety, or as part of a business reorganization subject to appropriate safeguards.
We do not sell personal information.
9. Processing outside Quebec
Some providers may process or store information outside Quebec or Canada. In that case, the information may be subject to the laws of the relevant jurisdiction. We assess risks and put appropriate contractual, technical, and organizational measures in place before such disclosure.
10. Retention
We retain information only for the period necessary for the purposes described, account maintenance, security, dispute resolution, and compliance with our legal obligations.
After an account is closed, some data may temporarily remain in backups or be retained where justified by a legal obligation. Data that is no longer needed is deleted or reasonably anonymized.
11. Security
We apply administrative, technical, and physical measures proportionate to the nature of the information, including encryption of communications, access controls, security logs, backups, and software updates.
No method of transmission or storage is entirely risk-free. In the event of an incident presenting a risk of serious harm, we will take the measures required by law and notify affected individuals where necessary.
12. Your rights
Subject to exceptions provided by law, you may request:
- access to the personal information we hold about you;
- correction of inaccurate or incomplete information;
- withdrawal of optional consent;
- deletion or deactivation of the account where applicable;
- information about the use and disclosure of your data;
- portability of certain computerized information where that right applies.
We may need to verify your identity before responding. A request may be sent to [email protected]. We will respond within the time limits provided by law.
13. Complaints
A privacy concern may be sent to the person responsible at [email protected]. We will review the request and try to resolve it diligently. You may also contact the competent privacy authority.
14. External links and services
The service may contain links to external sites or services. Their handling of information is governed by their own policies. We recommend reviewing those policies before providing them with data.
